Orcus Law Firm proudly announces another major victory before the Ontario Landlord and Tenant Board (LTB) in Rawal v. Noel (2024 ONLTB 30550). Representing landlords Pradeepkumar and Chaya RawalAdvocate Shikha Kapoor successfully demonstrated the landlords’ good faith in seeking possession of their Mississauga property for family use.

The case centered on the landlords’ application to recover possession of their rental home for their son’s personal use — a right protected under Section 48 of the Residential Tenancies Act, 2006. The tenants opposed the application, alleging harassment and lack of genuine intent. However, through clear documentation and credible testimony, Orcus Law Firm established that the landlords’ son genuinely intended to occupy the property for at least one year to settle and start a family.

After a thorough review of the evidence, the LTB ruled that the landlords had acted in good faith and met all statutory obligations, including serving a valid N12 Notice and providing required tenant compensation. The Board found the landlords’ testimony consistent and persuasive, rejecting the tenants’ allegations of bad faith.

The final decision ordered the termination of tenancy, granting the landlords the right to repossess their property. It also directed the tenants to pay daily compensation of $93.70 from the date of eviction, until vacant possession, along with $186 in legal filing costs.
